Federal law requires all parties in a business to have a legal right to work in the United States. Form I-9, Employment Eligibility Verification, must be completed by all employees of a small business. If the small business owner works in the corporation, LLC or partnership performing duties that could be performed by an employee, the owner should also complete an I-9. The form is kept in the company’s personnel files and produced when an inspection occurs. Owners of sole proprietorships do not need to complete the form.
